HellionFab – User Agreement

HELLIONFAB TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your access to and use of HellionFab (“HellionFab,” “we,” “us,” “our”), including our website hellionfab.com (the “Site”), and any design, prototyping, 3D printing, fabrication, consulting, and related services (collectively, the “Services”). By using the Site, submitting a request, uploading files, paying an invoice, or accepting a quote, you agree to these Terms.

If you do not agree, do not use the Site or Services.


1) ELIGIBILITY
You must be at least 18 years old (or the age of majority where you live) to submit a project request or place an order.


2) SERVICES OVERVIEW
HellionFab provides custom prototyping and manufacturing assistance, including (but not limited to):
- CAD/design support and iteration
- 3D printing and prototype builds
- Part fitment, adjustments, and refinement

IMPORTANT: Unless explicitly agreed in writing, Services are provided for prototyping and general-use purposes and are not certified for life-critical, medical, aerospace/flight, firearm-related, or regulated applications.


3) QUOTES, ORDERS, AND CHANGES
3.1 Quotes & Estimates
Quotes may include assumptions about materials, finish, tolerances, orientation, supports, post-processing, and shipping. Quotes are valid for 14 days unless stated otherwise.

3.2 Order Acceptance
An order is accepted only when we (a) confirm in writing, and/or (b) begin work, and/or (c) receive payment or a deposit.

3.3 Revisions / Scope Changes
If you change requirements after approval (dimensions, material, quantity, finish, tolerances, etc.), additional fees may apply and timelines may change. We will confirm any added cost before proceeding when practical.


4) CUSTOMER RESPONSIBILITIES
You agree that:
- You will provide accurate information and requirements (including intended use, constraints, and environment).
- You are responsible for confirming fitment, compatibility, and compliance for your specific application.
- You will not request prohibited items or uses (see Section 5).
- You have the legal right to provide any uploaded files and instructions (see Section 8).


5) SAFETY POLICY & PROHIBITED REQUESTS (NO WEAPONS / NO ILLEGAL USE)
HellionFab does not design, manufacture, modify, or assist with any request that we reasonably believe is intended for harm or unlawful use.

Prohibited requests include, without limitation:
- Weapons of any kind, weapon components, accessories intended to weaponize an item, or parts meant to be used in or with a weapon
- Firearm parts (including frames/receivers), magazines, suppressors/silencers, ammunition-related items, or any regulated weapon-related components
- Items intended to injure, intimidate, restrain unlawfully, or facilitate violence
- Items intended to facilitate illegal activity or evade law enforcement
- Any request that violates applicable laws or regulations

Right to Refuse
We reserve the right to refuse, cancel, or discontinue any request at any time if safety, legality, or compliance is unclear. We may require additional information about intended use before proceeding.

Customer Certification
By submitting a request or placing an order, you certify your request is for lawful use and not intended for any prohibited purpose.


6) PROTOTYPE DISCLAIMER (NO CERTIFICATION / NO GUARANTEE OF FITNESS)
3D printed and prototype parts may have inherent limitations, including layer anisotropy, dimensional variation, surface finish variation, and material-specific weaknesses.

Unless explicitly agreed in writing:
- We do not guarantee a part is suitable for a particular purpose, load case, environment, or regulatory standard.
- You are responsible for selecting appropriate safety factors, testing, and validation.


7) TIMELINES, SHIPPING, AND RISK OF LOSS
7.1 Timelines
Turnaround times are estimates and may change due to revisions, queue, material availability, printer downtime, or unexpected complexity.

7.2 Shipping
If we ship your order, shipping costs and carriers are selected per quote/invoice. Risk of loss transfers to you upon delivery to the carrier unless your local law requires otherwise.


8) INTELLECTUAL PROPERTY & UPLOADED CONTENT
8.1 Your Content
You retain ownership of any files, designs, logos, text, and specifications you provide (“Customer Content”). By submitting Customer Content, you grant HellionFab a limited license to use it solely to provide the Services (e.g., prepare, slice, manufacture, and communicate about your project).

You represent and warrant that:
- You own or have permission to use Customer Content, and
- Your request does not infringe any third-party rights (copyright, patent, trade secret, trademark, etc.).

8.2 Our Content
HellionFab’s site content, branding, graphics, copy, and internal methods are owned by HellionFab and may not be copied or reused without permission.

8.3 Portfolio Use (Optional)
Unless you notify us in writing before work begins, you grant HellionFab permission to photograph and display non-confidential aspects of completed projects (e.g., product photos) for marketing/portfolio purposes. We will not publish sensitive files or proprietary drawings without permission.


9) PRICING, DEPOSITS, AND PAYMENT
- Payment terms are as stated on your quote/invoice.
- We may require a deposit before starting work.
- Late payments may pause work and delay delivery.
- You are responsible for taxes (sales/use/VAT) where applicable unless we collect them.


10) CANCELLATIONS, CHANGES & REFUNDS (FLEXIBLE POLICY)
Because many HellionFab projects are custom, refunds depend on the project stage. Our goal is to be fair and keep you moving forward.

10.1 Cancel Before Work Starts
If you cancel before we begin any work (design, setup, printing, or material purchasing), we will refund your payment minus non-recoverable fees (e.g., payment processing fees) if applicable.

10.2 Cancel After Work Has Started
If you cancel after we’ve started work, we can typically offer one of the following (at our discretion, based on project stage):
- Partial refund for any unused portion of the order minus time already spent and any materials already purchased/used, OR
- Store credit for the remaining unused portion (valid for 12 months), OR
- Convert your order to a revised scope (e.g., smaller quantity, simpler version) to fit your new needs/budget.

Design/engineering time already performed and printed parts already produced are not refundable.

10.3 Changes & Revisions
If you request changes after approving a quote, file, or concept, we’ll do our best to accommodate them. Changes may affect price, timeline, feasibility, and whether a reprint is needed. We’ll confirm any added cost before proceeding.

10.4 “Not Happy” Resolution (Satisfaction Approach)
If you’re unhappy with the result, contact us within 14 days of delivery. We’ll work with you to resolve it through one or more of the following:
- a reasonable adjustment/reprint (when feasible)
- a partial refund
- store credit

The exact remedy depends on whether the issue is due to our process vs. your provided files/specifications/constraints.

10.5 Shipping & Return Notes
- Shipping fees are generally non-refundable once a label is purchased or an item has shipped.
- Custom parts are usually not returnable for resale, but we will still work with you under Sections 10.4 and 11 if there’s a confirmed defect or mismatch.


11) QUALITY, DEFECTS, AND REPRINTS
You must notify us of any claimed defect within 14 days of delivery.

If we confirm a defect caused by our manufacturing process (not your file/specs), we may, at our option:
- reprint/remake the part, or
- issue a partial/full refund for the affected item, or
- provide store credit.

We are not responsible for defects caused by:
- inaccurate or incomplete Customer Content/specs
- design choices requested/approved by you
- misuse, improper installation, or use outside stated conditions
- normal wear/tear or material limitations

If the issue is not a confirmed manufacturing defect but you’re still unhappy, we may offer a reprint, partial refund, or store credit under Section 10.4.


12) WARRANTY DISCLAIMER
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ANY PARTS OR DELIVERABLES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.


13) LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- HELLIONFAB WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION).
- HELLIONFAB’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID HELLIONFAB FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.


14) INDEMNIFICATION
You agree to indemnify, defend, and hold harmless HellionFab and its owners, employees, and contractors from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:
- your Customer Content or specifications
- your use, resale, or distribution of parts
- your violation of these Terms or applicable law
- alleged infringement of third-party IP rights related to your request


15) SITE AND FORM MISUSE
You agree not to:
- submit false information
- submit prohibited/unsafe requests
- attempt to bypass security measures or submit to our databases in unauthorized ways
- interfere with the Site’s normal operation

We may block or refuse service if we suspect abuse.


16) FORCE MAJEURE
We are not liable for delays or failures caused by events outside our reasonable control (e.g., supply shortages, carrier delays, power outages, natural disasters).


17) GOVERNING LAW & DISPUTES
These Terms are governed by the laws of the State of New York, without regard to conflict of laws rules.

Any dispute arising out of or relating to these Terms or Services shall be brought in the state or federal courts located in Richmond County, New York, and you consent to jurisdiction and venue there—unless applicable law requires otherwise.


18) CHANGES TO THESE TERMS
We may update these Terms from time to time. The “Last Updated” date indicates when changes take effect. Continued use of the Site or Services after changes means you accept the updated Terms.
